How to get married when your partner is incarcerated.

In a world of unpredictability, things can happen in moment’s notice to change our world for the better or worse. When that happens to be your partner becoming incarcerated, that is not the end-all-be-all! 

If you are in love and want to tie the knot with your partner who is incarcerated, there is hope! 

Follow this step-by-step guide on how to marry your partner while they are incarcerated, whether or not you are physically near each other.

In order to marry your partner who is incarcerated, you have two options:

To get married by a chaplin at the facility where your partner is incarcerated, you can have your partner discuss this option with the warden of the facility. 

To get married online through a video call, whether or not you are physically near each other, you need to make sure two things are in place:


First, you need to be allowed video visits with your partner who is incarcerated.

Video visits can be any type of video call; being on video is how to make this happen legally. Getting married through a video call simplifies the process, and is convenient when you are not near each other.


Second, you need a marriage license.

A marriage license shows the government has given legal permission for a couple to be married. Getting a marriage license with an incarcerated partner requires a little more process because that partner will not have a standard government-issued ID, such as a driver's license, passport, or state ID card. Rather, they usually have a facility ID. 

Steps to getting a marriage license when a partner is incarcerated:

  1. Email the Utah County marriage license office and ask for an Absentee form
  2. Send the absentee form to your partner who is incarcerated and have them fill it out and notarized.
  3. Have the facility send the completed and notarized absentee form back, to the marriage license office, along with a photocopy of your partner's facility ID: Utah County Marriage License Office, 111 S University Ave, Provo UT 84606
  4. Click the application link to start the marriage license application online, but do not finish your partner's section just yet.
  5. Contact the marriage license office to let them know who your partner is so they can add them to your marriage license application.
